Item Title:Consider Appeal of a decision of the Conditional Use and Variance Board (CUVB), Application CU2023-017, Tyler Plaza West

Background:

On November 16, 2023, the Conditional Use and Variance Board issued a denial of application CU2023-017, filed by Tyler Plaza West for an Conditional Use permit pursuant to Nassau County Land Development Code, Section 16.03(E), to allow for the sale of on-site or off-site consumption of beer and wine in the Commercial General (CG) zoning district. The subject parcel is located on the south side of SR200, between Meadowfiled Bluffs Road and Tyler Plaza. 

 

Pursuant to Nassau County Land Development Code, Section 5.06 Tyler Plaza West, represented by Sodl & Ingram PLLC, filed a timely appeal of the Conditional Use and Variance Board's decision with the Clerk's office. On January 8, 2024 this Board set the public hearing for February 12, 2024 at 6:00 p.m. or as soon thereafter as the matter may be heard.

Request:
Consider Appeal of Application, CU2023-017 challenging a decision of the Conditional Use and Variance Board's (CUVB) denial of conditional use permit as stated above. The Board of County Commissioners, after hearing, may reverse, affirm, or modify the order denying the conditional use permit to the applicant.
