The Board of County Commissioners of Nassau County, Florida, enacted Ordinance No. 2000-37 to provide for the creation of Assessment Areas and authorize the imposition of special assessments to (1) fund the construction of Local Improvements to benefit property located in proposed Assessment Areas and (2) the cost of maintaining such Local Improvements.
On November 10, 2003, the Board of County Commissioners of Nassau County, Florida, imposed special assessments within the Amelia Concourse Assessment Area by its Resolution No. 2003-141. Pursuant to that certain Development Agreement, dated as of September 8, 2003, among the County and the property owners within the Amelia Concourse Assessment Area, the property owners within the Amelia Concourse Assessment Area are limited to developing their property to the extent of daily trips (measured in ERUs) assigned to such parcels for purposes of imposing the Assessments
465 ERUs are assigned to Parcel L of the Amelia Concourse MSBU. Of those 465 ERUs 332 ERUs remain unused. The ownership of the un-built portion of Parcel L is now fractured. As such, with the transfer of land there was a division of the remain ERUs between property owners within Parcel L. This Resolution formalizes the assignment of ERUs internal to Parcel L. No ERUs are eing transferred in to or out of Parcel L.

Consider a resolution formally allocating 332 ERUs to specific sub-parcels within Parcel L of the Amelia Concourse MSBU as follows:
153 ERUs to DFH Amelia LLC for use on a portion of Parcel L identified by Tax Parcel Number 30-2n-28-0000-0001-0050.
179 ERUs to Amelia Concourse SPE LLC for use on a portion of Parcel L identified by Tax Parcel Number 30-2n-28-0000-0001-0040.
