Item Title:Ordinance Amending Ordinance No. 2016-15, which imposed a temporary moratorium on Medical Marijuana Dispensing Facilities

Background:
On December 21, 2016 the Board of County Commissioners adopted Ordinance No. 2016-15 which imposed a moratorium on the establishment of medical marijuana dispensing facilities and acceptance and processing of applications in the unincorporated areas of Nassau County for a period of 180 days.  The moratorium expires on June 21, 2017.  Due to the Florida Legislature not enacting legislation pursuant to Amendment 2, it is necessary for the Board to extend the current moratorium for an additional ninety (90) days in order for the County to determine proper regulations regarding such businesses and facilities, if deemed advisable, and is in the best interest of the public health, safety and general welfare. Based on the Florida Legislature's actions, the Florida Department of Health is responsible for promulgating rules as to Medical Marijuana Facilities, and at this time those rules have not been finalized.  This is the first of two public hearings to be held.   The second public hearing will be held on June 12, 2017.

First public hearing for consideration of an Ordinance of the Board of County Commissioners of Nassau County, Florida, amending Ordinance No. 2016-15, which imposed a 180 day moratorium on the establishment of medical marijuana dispensing facilities and acceptance and processing of applications in the unincorporated areas of Nassau County, Florida; specifically to amend Section 5 to extend the moratorium for an additional ninety (90) days. (Second public hearing scheduled for Monday, June 12, 2017 at 6:00 p.m.)
