Item Title:Consideration for Amendments to the Land Development Code and Ordinance No. 81-22, as amended, regarding Sunday Sales of Alcholic/Intoxicating Beverages

Background:

Staff has been requested to amend its Land Development Code regarding the sale of alcoholic/intoxicating beverages in a Commercial Intensive (CI) zoning district.  It will also be necessary to amend Ordinance No. 81-22, as amended, to make the regulations consistent.

The proposed ordinances will accomplish the following:

1.     Eliminate the 1,000 airline foot restriction for establishments selling off premise consumption for alcoholic/intoxicating beverages in the A1A/SR200 Overlay District.

2.     Eliminate the 1,000 airline foot restriction for establishments selling off premise consumption for alcoholic/intoxicating in the unincorporated area of Amelia Island. 

3.     Makes the provisions of Section 33.01(E) of the Land Development Code and Ordinance 81-22, as amended, Section 4, Limit of Sales, consistent regarding resort businesses, including restaurants within the resorts, in the tourist overlay district in the unincorporated areas of Amelia Island.

4.     Permits restaurants in the SR200/A1A Access Management Overlay District to sell, serve or permit to be served commencing at Noon on Sunday, in conjunction with meals.

5.     Permits vendors for off-premises consumption in the unincorporated area of Amelia Island to commence serving on Sundays at Noon.

6.     Permits sale for off-premise consumption within the SR200/A1A Access Management Overlay District at Noon.

Request approval for public hearings to commence and authorize staff to advertise public hearings to: (1) consider amending the Land Development Code, specifically Article 33, District Restrictions for Certain Land Uses, Section 33.01, Vendors of Alcoholic/Intoxicating Beverages and Bottle Clubs, specifically amending Section 33.01(A), Section 33.01(D), Section 33.01(E) and Section 33.01(F); and to (2) consider an ordinance amending Ordinance No. 81-22, as amended, specifically amending Section 2, Purpose, Section 3, Definitions, and Section 4, Limit of Sales; providing an effective date.

Request Board consideration to allow for public hearings to be conducted by the Planning and Zoning Board and the Board of County Commissioners to:   

(1) consider an ordinance amending the Land Development Code, specifically Article 33, District Restrictions for Certain Land Uses, Section 33.01, Vendors of Alcoholic/Intoxicating Beverages and Bottle Clubs, specifically amending Section 33.01(A), Section 33.01(D), Section 33.01(E) and Section 33.01(F); and

(2) consider an ordinance amending Ordinance No. 81-22, as amended, amending Section 2, Purpose, Section 3, Definitions, and Section 4, Limit of Sales; providing an effective date.
