Item Title:Marsh View Villas

Background:

Over the last 18 months the Development Review Committee members have met with the representatives of the Marsh View Villas condominimum developement. It is the desire of the property owners to transition the condominium community to a townhome community. The transition will allow for the creation of individual Lots associated with each unit that can be conveyed fee simple. Based on conversations with the community's represnetives, there is unanimous support from the existing property owners as the transition will result in a number of individual benefits. 

Due to the unique nature of the request, the transition will require a rezoning to PUD. Section 25.03 LDC states, "All PUDs should have a minimum site area of ten(10) upland acres". The subject property measures 4.57 acres. Based on the uniqueness of this request (the fact it will not change the physical environment nor create additional impacts) it is Staff's opinion that a rezoning to PUD is the cleanest and most appropriate means to accomplish the property owners' goal.
