Background:

On January 23, 2017, after an extensive public hearing process, Nassau County executed a significant overhaul to the local regulations governing the subdividing of lands for the purpose creating new building sites. During those initial efforts it was decided by the Planning and Zoning Board to bifurcate the amendment process and address the transfer of land between family members subsequent to the adoption of the greater Code revisions. After several months of public workshops and the required Public Hearing, the Planning and Zoning Board have prepared a series of amendments to the Land Development Code (Ord. 97-19) and the Subdivision and Development Review Regulations (Ord. 99-18).

 

The amendment to Article 22 of the Land Development Code removes language related to the division of land and places the language, as modified in the sister Ordinance being heard contemporaneously, in the more Subdivision and Development Review Regulations. The amendment to Article 22 LDC also removes dated and unnecessary langauge/references that is either currently found in, or has already been removed from, the Comprehensive Plan of Nassau County. This amendment also creates a uniformed minimum lot width for all properties in the Open Rural zoning district and establishes a maximum height limit for non-agricultural buildings.

 

The first public hearing was held on Monday, June 12, 2017 and a second public hearing was held on July 10, 2017. The County Attorney's Office indicated that the Board did not vote to approve the Ordinance at the July 10th hearing so staff was directed to place this back on the July 24th agenda for a vote.

Request:

Continue second public hearing to consider an Ordinance of the Board of County Commissioners of Nassau County, Florida, amending Ordinance No. 97-19, as amended, known as the Nassau County Zoning Code; specifically amending Article 22; Section 22.04, Minimum Lot Requirements; amending Section 22.06, Building Restrictions; rescinding Section 22.07, Density Requirements; and providing an effective date.


Financial/Economic Impact to Future Years Budgeting Process or Effect on Citizens:
Net Positive.  The application of subdivision rules will limit liability to the county for road maintenance/construction.  The rules will also inhibit sprawl into areas of the county that later require other services (such as school, fire stations, etc) while at the same time making a provision for family hardships and clarifying the appeal process.
Action Requested and Recommendation:

Continue second public hearing to consider the proposed amendments to Article 22 of the Land Development Code of Nassau County (Ord. 97-19). Set the second public hearing date for July 10, 2017. Staff recommends the Board consider favorably the proposed amendments to the Land Development Code (Ord. 97-19) and the sister amendments to the Subdivision and Development Review Regulations (Ord. 99-18).
