Item Title:2nd Public Hearing re: Medical Marijuana Facilities

Background:
The Planning and Zoning Board has voted to recommend that the Board conduct public hearings for the consideration of an ordinance that would include medical marijuana treatment center dispensing facilities as a permitted use within those zoning districts that allow pharmacies and to provide distance restrictions.  Pursuant to SB 8-A, a county may not enact ordinances for permitting or for determining the location of dispensing facilities which are more restrictive than its ordinances permitting or determining the locations for pharmacies licensed under Chapter 465, Florida Statutes.  On August 14, 2017, the Board approved to set two public hearings for August 28, 2017 and September 11, 2017 for the consideration of the ordinance.  This is the second public hearing.
Request:
Second public hearing for consideration of an Ordinance, amending Article 15, Commercial, Neighborhood (CN), Article 16, Commercial, General (CG), Article 17, Commercial, Intensive (CI), amending Article 26 - Commercial, Judicial (CJ), to include Medical Marijuana Treatment Center Dispensing Facilities as permitted use, and to provide for distance restrictions; amending Article 15-A, Commercial, Neighborhood - American Beach; CN-AB, specifically amending Section 15-A.01(A), eliminating retail outlets for the sale of drugs; amending Article 16-A - Commercial, General - American Beach: CG-AB, specifically amending Section 16-A.01(B), eliminating retail outlets for the sale of pharmaceuticals; and amending Article 32 of the Land Development Code to include a definition of Medical Marijuana Treatment Center Dispensing Facility; providing for codification; providing for severability; and providing an effective date.
