Item Title:Crane Island Phase I

Background:

The developers of Crane Island have submitted a preliminary plat for Phase 1 Crane Island (copy attached).  Changes are being proposed to the Adoption and Dedication language that will be added to the front page of the preliminary plat once the language has been approved.   The language is with regard to the dedication of Tracts 2 and 12 which make up the public park.  The HOA will, in return, agree to maintain the park at their expense.

The PUD allows for the County to take title to the park with the Board's approval. A copy of the current PUD development conditions, pursuant to Ordinance No. 2006-80, as amended by Ordinance No. 2013-16, is attached.   (See Section 2(a)(2)).

The Developers will be responsible for constructing and maintaining the park including the amenities therein.  The Board of County Commissioners will provide liability insurance. 

The Comprehensive Plan, Policy ROS 01.04, provides that the Board of County Commissioners may own or manage through agreement community and regional park facilities to achieve the adopted levels of service.

 

Request:
Consider whether the Board desires to own the public property in Tracts 2 and 12 of Crane Island, Phase I, and if so, to approve the amended language to be incorporated into the second paragraph of the Adoption and Dedication language for the Crane Island, Phase I, plat.
Financial/Economic Impact to Future Years Budgeting Process or Effect on Citizens:
The Developers of Crane Island will be responsible for constructing and maintaining the park including the amenities therein.  The Board of County Commissioners will provide liability insurance.  Liability insurance for the public park facility will be included in the County's current policy.
Action Requested and Recommendation:

Consider whether the Board desires to own the public property in Tracts 2 and 12 of Crane Island, Phase I.  If the Board does agree, the following language is recommended to be included in the second paragraph of the Adoption and Dedication language for the Crane Island, Phase I, plat.  The proposed plat will then be placed on a future agenda for Board approval and recordation of the plat.

Proposed language:     ALL ALLEYS, EASEMENTS, RIGHTS OF WAY (CRANE ISLAND DRIVE, BROADBENT WAY, SWEETGRASS COURT, BALD EAGLE COURT, SALT HAMMOCK COURT, AND CORD GRASS COURT), TRACTS 2 AND 12 (PARK), AND PUBLIC AREAS SHOWN ON THIS PLAT ARE DEDICATED TO THE PUBLIC FOR THE USES AND PURPOSES THEREON STATED AS SET FORTH IN ORDINANCE NO. 2006-80, AS AMENDED, AND REMAINS THE MAINTENANCE OBLIGATION OF THE OWNER PROVIDED HOWEVER, THE UNDERSIGNED OWNER RESERVES THE RIGHT TO CONVEY TITLE TO SAID TRACTS TO AN ENTITY, INCLUDING WITHOUT LIMITATION, A PROPERTY OWNERS' ASSOCIATION, OR OTHER SUCH ENTITY AS WILL ASSUME ALL OBLIGATION OF MAINTENANCE AND OPERATION THEREOF UNDER THE PLAT PURSUANT TO AN INTERLOCAL AGREEMENT BY OWNER AND COUNTY, APPROVED BY THE BOARD OF COUNTY COMMISSIONERS.  NOTHING HEREIN SHALL BE CONSTRUED AS CREATING AN OBLIGATION UPON NASSAU COUNTY TO PERFORM ANY ACT OF CONSTRUCTION OR MAINTENANCE WITHIN SUCH DEDICATED AREAS.
