Item Title:Amendment to LDC Sec. 37.02-Tree Protection and Replacement Plan

Background:

The Planning and Zoning Board created The Amelia Island Tree Protection Working Group with the directive to conduct a fact finding mission analyzing the effectiveness of tree protection standards for the unincorporated areas of Amelia Island previously adopted in Ordinances 2008-1 and 2013-06 and present this information to the Nassau County Planning and Zoning Board.

The working group presented the Planning and Zoning Board with the results of the fact finding endeavors at a public workshop on April 3, 2018. A public hearing was held on May 15, 2018 to review a draft ordinance to modify the manner in which tree protection and replacement takes place in the unincorporated areas of Amelia Island. After taking public comment and hearing testimony the Planning and Zoning Board has put forth a recommendation of approval to the Board of County Commissioners.

These proposed changes apply to the unincorporated areas of Amelia Island only and are intended to preserve and enhance the unique maritime forest which benefits the health, safety and general well-being of the inhabitants of Amelia Island.

In order to maintain consistency throughout the Land Development Code, associated amendments to Section 37.05 – Landscaping and Article 35  - SR200/A1A Access Management Overlay and Section 32 - Definitions will be considered concurrently in separate ordinances.


Request:

Continue consideration of an Ordinance of the Board of County Commissioners of Nassau County, Florida, amending Article 37 of the Land Development Code, Natural Resource Protection; specifically rescinding the current Section 37.02, Native Canopy Tree Protection, and adding a new Section 37.02, Amelia Island Tree Protection and Replacement; amending Article 32  of the Land Development Code, Definitions, providing for penalty; providing for enforcement; providing for severability; providing for codification; and providing an effective date.

The Planning and Zoning Board and PEO Staff recommend approval.
