BOCC AGENDA ITEM

Item Title:Update on Dyal Road Right of Way Acquisition
Date:2/11/2019
Department:Public Works / Engineering Services
Background:

FDOT has included in their budget a portion of the funds needed for paving the .5 mile unpaved portion of Dyal Road.  The paving of the portion of Dyal Road will improve not only the surface of the road, but also the drainage and is expected to benefit property owners and citizens who utilize Dyal Road.  Paving Dyal Road requires the County to obtain 10 feet of land from each citizen that owns property on the unpaved portion of Dyal Road to have the necessary right of way.

The Engineering Services Department sent letters to the property owners in August and December of 2018 notifying them of Nassau County's intention to pave the unpaved portion of Dyal Road and asking for the additional right of way.  Only seven of the eleven property owners have agreed to provide the necessary land for right of way.

Engineering Services staff proposes asking FDOT to consider a Double Chip Seal surface for this portion of roadway as this will improve the road surface and drainage, but not require the right of way from property owners.

Request:
Consider the following: 1) authorize Engineering staff to notify the Florida Department of Transportation that the County has been unable to obtain the necessary right-of-way from each property owner for paving of Dyal Road; and 2) authorize staff to propose the FDOT consider the use of available paving funds to be used for Double Chip Seal of Dyal Road.
