| | | | | | | | | Background: | | Pursuant to the Nassau County Comprehensive Impact Fee Ordinance, as amended, Nassau County requires any person who seeks to develop land within Nassau County, as evidenced by such person's application for a building permit or certificate of occupancy to pay Recreation/Community Park Facilities Impact Fee so as to assure that such new development bears a proportional share of the cost of capital expenses necessary to provide recreation within nassau County. Patriot Ridge LLP is dedicating land and making improvements for recreation/community park use as required by the PUD, which is recognized as meeting the requirements for impact fee credits. Pursuant to the terms of the Imact Fee Ordinance, Nassau County and Patriot Ridge LLP desire to set forth their agreement and a procedure for the application and treatment of such impact fee credits. Further, the Nassau Crossing PUD requires a recreational component located in "Parcel C" of the approved Nassau Crossing PUD named William Burgess Community Park.
