Background:

The proposed rezoning is located on the east side of Roses Bluff Road between Brooker Road and Haven road. It comprises one parcel totaling 53.88 acres. The rezoning request is from Open Rural (OR) to Residential Single-Family 1. The property is currently vacant.

Based on the lack of conformance to Comprehensive Plan and Land Development Code criteria as presented in the staff report, Staff is recommending denial of this application.

The Planning and Zoning Board recommended denial of this application at their meeting on July 21, 2020.

Under the terms of the adopted Inter-local Agreement between the County and School Board, a rezoning can not be considered for adoption until school concurrency requirements have been satisfied. The applicant has been made aware of these provisions and is currently in negotiations with the School Board to address its proportionate share of impacts to school capacity in this area. Staff requests that this item be continued until such negotiations are concluded and a proportionate share agreement is in place. Applicant has withdrawn the rezoning application.
