Item Title:Set Public Hearing on Amendment to Ordinance 2020-31 Regarding Beach Restrictions

Background:

Ordinance No. 2020-31, Providing for the Restrictions for Driving and Parking in the Unincorporated Areas of the Beaches of Nassau County was adopted by the Board of County Commissioners on October 12, 2020.  It has become necessary to amend Ordinance No. 2020-31, specifically to Section 1, Motorized Vehicles on the Atlantic Ocean Beaches and Section 4, Regulated Fires on the Beach.

 

The proposed amendments to be considered are narrow and limited to:

  • Section 1 (2)(f) to add "driving and":  Annually, the Board of County Commissioners may, at the recommendation of the County Manager, restrict driving and parking, based on factors determined by the County Manager in areas located directly in front of the Peters Point Park and Burney Park. The factors and restrictions shall be set forth in a resolution to be considered by the Board of County Commissioners at a publicly noticed meeting. 
  • Removal of Section 1 (10): Receipt of a vehicle pass, issued by Nassau County, subjects any vehicle to a search and a search of any cooler in the vehicle or trunk and confiscation of any alcoholic beverage. If a driver does not consent to a search, a pass will not be issued, and the vehicle cannot park or drive on the beach.
  • Section 4 (2)(a) to remove "or areas outside the designated areas for vehicles":  No fires allowed in the dunes or areas outside the designated areas for vehicles

 

Unless otherwise directed by the Board of County Commissioners, the above amendments are the only changes that will be considered.

Financial/Economic Impact to Future Years Budgeting Process or Effect on Citizens:
It is in the best interests of Nassau County residents to amend Ordinance 2020-31, beach regulations.  Specifically, the requested amendments will be eliminating vehicle searches on the beach, as well as allowing fires on the beach.  Fires on the dune areas will still be prohibited.
