Item Title:Consideration of Mobility Fee Credit Agreement with Nassau Station PUD

Background:

Nassau Station Planned Unit Development (PUD) was established November 26, 2018 by the implementation of Ordinance 2018-43. Consistent with the PUD, the developer of Nassau Station PUD, Patriot Ridge, LLP, requested County staff to review a proposal providing credit for Mobility Fees in exchange for right of way improvements to Harvester Street as well as the construction of a trail and parking stalls along William Burgess Boulevard.

 

Section Q(b) of Ordinance 2018-43 states:

 

(2) Mobility Fee Credits shall be governed by Section 3.02 of the Nassau County Mobility Fee Ordinance in effect at the time of approval of this PUD and shall be subject to a Credit Agreement approved by the County Manager and the Board of County Commissioners. The transferability of credits to other owners and properties within the Mobility Fee Zone located outside of the Nassau Station PUD shall be considered in said agreement. Nothing herein shall prevent credits from being transferred to other owners and properties within the boundaries of the Nassau Station PUD.

 

(2) Actual Mobility Fees will be calculated based on fee amount at the time of building permit unless otherwise provided for in a separate agreement whereby fees are advanced and credits given.

 

 

Staff from Planning and Economic Opportunity, Office of Management and Budget, as well as Engineering Services reviewed the proposal and the Staff Report is attached to the agenda request.  Staff have concluded the following:

 

  • The request meets conformity to the County Transportation System.
  • The proposed donation of land and construction by the developer is consistent with the public interest.
  • The proposed time schedule is consistent with the Capital Improvement Program for the County Transportation System.
  • The Mobility Fee Credits may be transferred or applied to developments other than Nassau Station with the condition that all transfers will be approved by the Nassau County Manager or his/her designee.
  • The appraisal valuation submitted by the developer can be utilized and Mobility Fee Credits may be authorized for:

 

Right of Way Donation                                                          $ 86,000

Improvements to Harvester Street $                                       169,742

Trail & Parking Construction along William Burgess Blvd.    56,160

The Warranty Deed transferring the ownership of the Harvester Right of Way, the recorded plat, appraisal, and Ordinance 2018-43 are attached to this agenda item.


Request:
Approve the Mobility Fee Credit Agreement, Contract No. CM 2971, with the Nassau Station developer, Patriot Ridge, LLP for a total credit of $311,902.
Financial/Economic Impact to Future Years Budgeting Process or Effect on Citizens:

The mobility fee credits will result in the improvement of the right of way at Harvester Street and provide the construction of a trail for the citizens of Nassau County along William Burgess Boulevard allowing improved safety and additional transportation options.


Action Requested and Recommendation:

Approve the Mobility Fee Credit Agreement, Contract No. CM 2971, with the Nassau Station developer, Patriot Ridge, LLP for a total credit of $311,902.
