The applicant is requesting a rezoning from OR to Planned Unit Development (PUD). The PUD development program includes 106 single-family housing units, a 0.7 acre neighborhood park at the subdivision entrance, a 1.8-acre centrally-located neighborhood park, a 3.1-acre waterfront park/preserve, and an interconnected pedestrian circulation system of sidewalks and walking trails.
The proposed PUD zoning district would be consistent with the existing Low Density Residential (LDR) Future Land Use Map (FLUM) designation.
This property was previously a candidate for rezoning to RS-1 zoning, but the application was recommended for denial on a close vote by the PZB at their July 21, 2020 meeting (the application was later withdrawn and did not proceed to the Board of County Commissioners). Staff recommended denial at the time recognizing the rural character and larger lots of the area along Roses Bluff Rd. west of Coopers Way. However, the Staff report at the time also made the point that the property was close to central water and sewer, which could steer development toward smaller lots for more efficient service provision, thereby justifying smaller lot sizes. Another deficiency in the 2020 application was the request for the conventional RS-1 district, which provided no promise of upgraded development and public benefit, both of which can be achieved through the PUD process.
On July 6, Staff presented a report to this board recommending approval with conditions related to several items within the proposed PUD.
The Board voted to continued this item to the July 20, 2021 meeting.
The applicant re-submitted a revised preliminary development plan and PUD conditions to address the conditions of the previous staff report on July 6. A revised staff report reviewing these changes and recommending approval was issued for the July 20 meeting.
On July 20, the Planning & Zoning Board recommended approval of this application.
The proportionate share mitigation agreement for this development to address school concurrency requirements was executed by the School Board on June 24, 2021 was approved by the Board of County Commissioners on July 26, 2021.
The item was continued from the July 26, 2021 BoCC meeting due to concerns raised by the County Attorney regarding ADA access to the waterfront park. Since that meeting, Planning Staff has met multiple times with the County Attorney, County Engineer, and Building Official to make the revised PUD less ambiguous and to provide for clear enforcement, as well as to clarify ADA handicapped access for the trails and dock.
