Item Title:Approval of Negotiated Offer for William Burgess Right of Way Acquisition

Background:

The Florida Department of Transportation and Nassau County Board of County Commissioners have been working on the William Burgess Extension design from US 17 and William Burgess to Miner Road in Yulee.  To construct the plans, right of way acquisition is necessary.  Owners of property in the proposed right of way were sent a Notice to Owner in August 2020, and a Statement of Offer was sent to the property owner in November 2020.

 

James Taylor owns Parcel ID #42-2N-27-0000-0001-0220.  Initially Mr. Taylor was offered $41,600 for the entire parcel.  After further review it was determined that only a 3,175 square foot portion of the parcel was required for the project and Mr. Taylor was offered $3,969 for this corner clip.  On behalf of Mr. Taylor, his attorney counteroffered $161,645 based on appraisal reports and estimated severance damages based on the property no longer having access from Miner Road.  Mr. Taylor was then offered $9,557 for the required corner clip at Miner Road and installation of a driveway from Miner Road.  Mr. Taylor’s attorney then requested a second driveway along the new William Burgess Extension.  The offer of $9,557 with a total of two driveways was accepted.  The estimated cost of each driveway is $5,000.

Request:
Consider the following: 1) Approve the purchase of a 3,175 square foot corner clip of parcel #42-2N-27-0000-0001-0220 in the amount of $9,557 from James Taylor and include two driveways to be installed on the remainder of parcel #42-2N-27-0000-0001-0220; 2) Authorize payment of $5,144.04 for Statutory Attorney fees; 3) Authorize $11,548.75 for appraisal fees; 4) Authorize the County Attorney to proceed with closing.
Financial/Economic Impact to Future Years Budgeting Process or Effect on Citizens:

The William Burgess Extension will allow an alternative to the SR 200 Corridor from the intersection of William Burgess and SR 200 to Miner Road. Completion of the project will require routine maintenance costs in future years.
