Item Title:Reduction of Penalty - Case 13-378, Nathaniel O. Mabry, Jr. n/k/a Nathaniel O. Mabry Estate

Background:

Sean H. Mabry (brother) is requesting a Reduction of Penalty on Nathaniel O. Mabry's Estate. Nathaniel O. Mabry, Jr. is deceased (April 1, 2021) and Sean H. Mabry and Nathaniel O. Mabry, Sr. are finalizing the estate.

 

January 8, 2013 the Code Enforcement Board motioned and seconded that Nathaniel O. Mabry was in violation of:

  • Ordinance 2003-17, Section 6.01 - general nuisances affecting public health
  • Ordinance 2003-17, Section 6.03 - duscard, place trash, litter or debris
  • Administrative fees of $286.28 were assessed to be paid by February 12, 2013
  • Fine of $50.00 per day was assessed to commence February 12, 2013

 

The property came into complaince on June 2, 2021. The fine accrued for 3,032 days.

$50 x 3,032 days =       $151,600.00
Administrative Fees              286.28

TOTAL                          $151,886.28

 

The Code Enforcement Board met on January 11, 2022 and made the following recommendation:

  1. waive the fine
  2. collect administrative fees of $286.28
Request:
Reduction of Penalty, Case 13-738, Nathaniel O. Mabry, Jr. n/k/a Nathaniel O. Mabry Estate
Financial/Economic Impact to Future Years Budgeting Process or Effect on Citizens:

Fines are assessed as an attempt to bring properties into compliance.  These fines do not have a negative budgetary impact on County operations and any fees collected are deposited in the general fund.  Administrative fees are actual costs incurred by the County to process the case.

Action Requested and Recommendation:
Consider the request from Sean H. Mabry and Nathaniel Mabry, Sr. for Reduction of Penalty for property located at 54291 Marlee Road, Callahan (Case 13-738) and the recommendation from the Code Enforcement Board to reduce the lien to the administrative cost of $286.28
