Item Title:Resolution Pledging Funds to the American Beach Water and Sewer District Assessment

Background:

On August 24, 2020, the Board of County Commissioners (BOCC), established the American Beach Water and Sewer District by Ordinance No.2020-26. The American Beach Water and Sewer District purpose is to construct water and sewer systems in the unincorporated area of the county within the boundaries of the District.

 

The American Beach Water and Sewer District is the best means of constructing and maintaining assets of water and sewer systems within the District. Nassau County BOCC has contracted with the Florida Governmental Utility Authority to carry out all professional engineering and capital project administration services during the design, bidding and construction phases of the improvement project.

 

 

On May 15, 2021, Affected Property Owners were sent survey ballots to determine the level of support for the Board of County Commissioners to create a special assessment program and assess each of the affected property owners in the District an annual non-ad valorem special assessment for the proposed water and wastewater capital improvements.  This assessment will fund the costs of these improvements within the project areas that are not covered by grant proceeds.

 

 

Sealed survey ballots were counted by an independent consultant on June 22nd and 23rd, 2021.  Of the 280 ballots mailed, 172 valid ballots were returned and counted.  Of the 172 valid votes, 148 votes were in favor of the annual non-ad valorem assessment to fund water and wastewater facilities to serve the District.

 

On September 13, 2021, the Board, sitting as the American Beach Water and Sewer District, approved the Final Assessment Resolution 2021-153, creating the assessment area and instituted an annual assessment on affected property owners.  The attached Resolution pledges $1.85m from all legally available, non-ad valorem funds to cover the assessment costs to affected residents.

Request:
Approve and authorize the Chairman to sign a Resolution pledging $1,850,000 of all legally available non ad-valorem funds to eliminate the American Beach Water and Sewer District Assessment.

This project will provide reliable fire protection and a more sustainable source of drinking water and wastewater disposal.  This project is funded through grants, forgivable loans, through special assessments and dedication of all legally available non ad-valorem funds.
Action Requested and Recommendation:
Approve and authorize the Chairman to sign a Resolution pledging $1,850,000 of all legally available non ad-valorem funds to eliminate the American Beach Water and Sewer District Assessment.
