Background:

The Parks, Recreation and Open Space Master Plan (PROSMP), adopted on January 25, 2021, included the requirement that trails designated as future facilities on the County’s Future Transportation Map Series (FTMS) be implemented by requiring developments to construct the section related to their development at the time development occurs.  In February, the Board adopted a policy to allow fee-in-lieu as an alternative to sidewalk and trail construction. Concurrent with CPA21-009 and CPA21-010, staff proposes to amend Section 29-46(b)(3) to recognize the recently-adopted fee-in-lieu program for trail facilities.

 

The Planning and Zoning Board recommended denial of the proposed Ordinance at its April 19, 2022 meeting. However, the item is scheduled to be reheard by the Planning and Zoning Board at its June 7, 2022 meeting.  (Staff requests this item be continued to the June 27, 2022 meeting)

Request:
Consider ORD22-001, an ordinance amending Chapter 29 of the County Code of Ordinances, Subdivision and Development Review, Section 29-46, Public Uses; specifically Section 29-46(b)(3), Trails, to add provisions of the adopted fee-in-lieu of required trail construction policy; providing for severability; providing for codification; and providing an effective date. (Staff requests this item be continued to the June 27, 2022 meeting)
Financial/Economic Impact to Future Years Budgeting Process or Effect on Citizens:
The County collects a fee-in-lieu of sidewalk and trail construction requirements for new development.
