Background:

Mr. Benjamin is requesting a Reduction of Penalty for property that was quit claimed on August 29, 2017. June 11, 2002 the Code Enforcement Board found that Daisy Nelson Estate was in violation of :

  • Ordinance 2003-17, Section 6.01- General nuisances affecting public health (Chapter 18 1/4, Section 5 )
  • Ordinance 2003-17, Section 6.03- Discard, place trash, litter, or debris (Chapter 18 1/4, Section 5, Subsection 3)
  • Ordinance 2000-26, Section 1.6- Maintenance of structure (Which has been replaced by Chapter 7, Article VII - Unsafe building abatement code)

On November 18, 2019, this parcel was annex to The Town of Callahan by Ordinance 2019-010. The lien stopped at that date. It was still in violation at time of annex. The fine accrued for 6,340 days.

Mr. Benjamin is requesting the Code Enforcement Board to make a recommendation to the BOCC to:

  • reduce the lien to $100.00

Staff recommends reducing the fine to the number of days it was in violation once Mr. Michael Benjamin obtained the property until annexed to The Town of Callahan.( August 29, 2017- November 18, 2019)

Fine $50.00 x 810 days (new ownership) = $40,500.00
