Item Title:CM3246, Agreement with Raydient LLC for Drainage, Reuse, and Maintenance of the Pond Parcel Adjacent to Pages Dairy Road and Chester Road

Background:

The approved Capital Improvement Plan includes improvements to the intersection of Chester Road and Pages Dairy Road.  During the design phase of this project it has been determined that a drainage pond will need to be constructed as part of the improvements.

Raydient LLC owns the land which is adjacent to Pages Dairy Road and Chester Road, and has agreed to allow the County to construct a drainage pond and related stormwater piping, outfalls, and other appurtenant drainage infrastructure on the “Pond Parcel” (Exhibit A of the Agreement for Drainage, Reuse, and Maintenance), which is located in the East Nassau Stewardship District.

The County will be responsible for the construction costs.  The County will maintain the pond at its own cost, until such time as the Pond is expanded for Raydient’s use.  Once the pond is expanded Raydient or it’s successor will take over maintenance of the pond.

 
Request:
Approve and authorize the Chairman to sign the Agreement for Drainage, Reuse, and Maintenance, Contract No. CM3246, with Raydient LLC to establish certain easements and ownership and maintenance obligations with respect to the Pond Parcel adjacent to Chester Road and Pages Dairy Road.
Financial/Economic Impact to Future Years Budgeting Process or Effect on Citizens:
Intersection improvements at Pages Dairy Road and Chester Road are budgeted within the approved CIP.  There is no cost to the County to enter into the agreement with Raydient LLC.  Construction costs for the pond will be included in the intersection improvement costs, and upon completion will be maintained within the Road Department’s operating budget.
Action Requested and Recommendation:

Funding to enter the agreement is not required.  The intersection improvements at Pages Dairy Road and Chester Road are budgeted in the County’s CIP (Project Code:  PDCII).
